These Terms of Use govern the access to and use of Architectjob.in, all related pages, accounts, databases, digital services and functionalities, the publication and promotion of vacancies, the creation and publication of candidate profiles and CVs, and every agreement concluded with Conceptfabriek CommV in connection with these services.
By visiting or using Architectjob.in, creating an account, uploading a CV or portfolio, applying for a vacancy, purchasing a package, publishing or submitting a vacancy, using an upload link, communicating through the website or otherwise using any part of the platform, you confirm that you have read, understood and accepted these Terms of Use.
Architectjob.in is a specialised international job platform connecting architects, architectural professionals, graduates, architecture practices, employers, recruiters and organisations in India and internationally. The platform may cover architecture, interior architecture and design, urban design and planning, landscape architecture, BIM, CAD, architectural visualisation, conservation, sustainability, project management and other architecture and built-environment disciplines, together with related design, technical, research and management positions.
Conceptfabriek CommV may change the content, availability, price, duration and specifications of packages and services at any time. Changes will not normally affect a paid service already confirmed, except where a change is required by law, by a third-party platform, for security reasons or to preserve the proper operation of the service.
The minimum age for creating an account or using the interactive services of Architectjob.in is eighteen years. By using the website, you confirm that you are legally capable of entering into a binding agreement. A person acting for an employer, architecture practice or another organisation also confirms that he or she has sufficient authority to bind that organisation.
These Terms of Use are effective from 7 August 2026 and replace all previous versions applying to Architectjob.in. The version published on the website at the time of use or purchase will apply, subject to any mandatory legal rights.
These Terms apply exclusively to the relationship between the user and Conceptfabriek CommV. Any general or specific purchasing, procurement or contractual terms of a user, employer, architecture practice, recruitment agency or other organisation are expressly excluded, even where those terms claim exclusive application, unless Conceptfabriek CommV has expressly accepted them in a separately signed written agreement.
Architectjob.in maintains a separate Privacy Policy explaining how personal data is collected, used, stored, transferred and protected. Personal data may be processed in Belgium, the European Economic Area, India and other countries in accordance with applicable data-protection law. Registration does not automatically constitute consent to receive promotional newsletters. Marketing communications will only be sent where a lawful basis exists, and users may unsubscribe or withdraw consent at any time.
Architectjob.in is a concept and service operated by Conceptfabriek CommV, Belgium, registered under Belgian enterprise and VAT number BE 0635.884.686. References in these Terms to “Architectjob.in”, “Conceptfabriek”, “we”, “us” or “our” refer to Conceptfabriek CommV.
Conceptfabriek is not responsible for selecting, screening, interviewing, engaging or employing candidates and does not act as the legal representative of an employer or candidate. Unless expressly agreed otherwise in writing, Conceptfabriek is never an architecture practice, recruitment consultant, employment agency, placement agency, labour contractor, employer of record, immigration adviser or intermediary negotiating an employment contract.
It is prohibited to approach, extract or systematically contact employers, architecture practices, candidates, commercial partners, advertisers or other users of Architectjob.in for the purpose of offering competing services, building an external database, conducting unsolicited marketing or promoting an unrelated initiative. Collecting personal data, email addresses, telephone numbers, vacancies, company information, practice information or candidate information through scraping, crawling, harvesting, copying or automated extraction is expressly prohibited.
Users must provide accurate, current and complete information. Conceptfabriek may request evidence of identity, authority, company or practice registration, professional status, Council of Architecture registration where relevant, recruiting-agent registration, contact details or payment information and may carry out manual or automated checks. Conceptfabriek may refuse, suspend or terminate accounts where information is false, incomplete, misleading, unverifiable or associated with fraud, abuse or unlawful activity.
Creating multiple accounts, using false identities, impersonating another person, architecture practice or company, sharing accounts, bypassing payment requirements, circumventing publication limits or attempting to regain access after suspension is prohibited. Related accounts may be treated as a single account and suspended together.
Job seekers may create a standard account and apply for vacancies free of charge, unless a specific optional paid service is expressly offered and ordered. Architectjob.in does not charge candidates a placement fee for obtaining employment.
Architectjob.in and its services are provided on an “as available” and “as is” basis. To the fullest extent permitted by mandatory law, Conceptfabriek makes no express or implied warranty regarding the accuracy, completeness, suitability, legality, availability, security, performance or results of the website, vacancies, candidate profiles, portfolios, employers, architecture practices, applications, external links or services.
No employment contract, internship agreement, consultancy agreement or independent-contractor agreement is concluded through Architectjob.in itself. Any agreement is concluded exclusively between the candidate and the relevant employer or contracting party. Conceptfabriek is not a party to that agreement and accepts no responsibility for negotiations, offers, rejections, salaries, working conditions, qualifications, professional registrations, visas, permits, relocation, onboarding, termination or performance.
Publication on Architectjob.in does not mean that Conceptfabriek acts as a recruiting agent or private placement agency. Employers, architecture practices, recruiters and agencies remain solely responsible for determining whether their activities require registration, authorisation, a licence, a permit, a local establishment or another regulatory approval in India or any other country.
No employer, foreign employer, architecture practice, recruitment agency or other user may use Architectjob.in to avoid or circumvent the Indian Emigration Act, applicable emigration rules, eMigrate requirements, recruiting-agent registration, employment permits, immigration requirements or any other mandatory rule governing the recruitment of Indian citizens for work outside India. Conceptfabriek may request proof of the required registration or permit and may reject or remove overseas vacancies without liability.
Employers are solely responsible for ensuring that every vacancy complies with all applicable central, state and local laws relating to employment, labour, wages, social security, workplace safety, working hours, internships, apprenticeships, equal opportunity, immigration, taxation, professional qualifications, architectural registration and regulated activities.
Conceptfabriek does not verify whether a candidate possesses the architectural degrees, recognised qualifications, Council of Architecture registration, memberships, licences, experience, portfolio experience, design competencies, technical competencies, immigration status or professional authorisations mentioned in a CV, portfolio, profile or application. Employers and candidates must independently verify all qualifications, registrations, references and legal requirements before entering into an employment, consultancy or other professional relationship.
The professional title “architect” is regulated in India under the Architects Act, 1972. Registration requirements, recognised qualifications and the use of the title may be subject to the Architects Act, rules and regulations issued under it, and requirements administered by the Council of Architecture (CoA) or other competent authorities. Publication of a vacancy using the word “architect” or another professional title does not constitute confirmation by Conceptfabriek that the position, employer or candidate satisfies any applicable registration or professional requirement. Employers and candidates remain solely responsible for verifying the lawful use of professional titles, required registrations and the scope of any professional activities.
Employers must conduct recruitment objectively, respectfully and lawfully. Vacancies may not contain unlawful discrimination, exclusion or preference based on caste, race, ethnicity, religion, sex, pregnancy, marital status, gender identity, transgender status, sexual orientation, disability, age, language, place of birth, social origin or another protected characteristic. Lawful affirmative-action measures or genuine occupational requirements must be clearly described and legally justified by the employer.
Vacancies may not require candidates to pay an undisclosed recruitment fee, security deposit, equipment fee, mandatory training payment or other amount as a condition for obtaining employment. Pyramid schemes, money-circulation schemes, deceptive commission structures, bonded labour, human trafficking, child labour, sham employment and vacancies intended to obtain money or personal data from applicants are prohibited.
Conceptfabriek is not responsible for disputes between employers, architecture practices, candidates, recruiters, contractors or other users. Users agree not to involve Architectjob.in or Conceptfabriek in claims concerning interviews, design tests, recruitment decisions, employment offers, background checks, professional registrations, workplace conduct, salary, benefits, dismissal, non-payment, discrimination, intellectual property created during employment or any other matter arising between those parties.
Employers may use candidate information solely for genuine recruitment relating to a current or reasonably anticipated position. Candidate information may not be sold, disclosed, harvested, enriched, used for unrelated marketing, added to an external commercial database or retained longer than reasonably necessary. Employers must implement appropriate security measures and comply with all applicable privacy and data-protection requirements.
An employer that downloads, receives or otherwise processes candidate information acts under its own responsibility and, where applicable, as an independent data fiduciary or data controller. The employer is responsible for providing any legally required notice, identifying a valid processing ground, respecting candidate rights and securely deleting information when it is no longer required.
Users can manage or request deletion of vacancies, profiles and accounts through the available dashboard or contact channels. Deletion from the active platform does not require the immediate deletion of information that Conceptfabriek must retain for security, fraud prevention, legal compliance, tax, accounting, evidentiary, backup or dispute-resolution purposes. Remaining copies will be isolated or deleted in accordance with the applicable retention policy.
The duration for which a vacancy remains visible depends on the package selected at the time of purchase. Conceptfabriek may temporarily suspend, extend, reposition, reformat or remove a vacancy where reasonably necessary for technical, editorial, legal, security or promotional reasons.
Vacancies may be reviewed by our team or by automated systems. Conceptfabriek may reject, edit, suspend, classify or remove a vacancy that does not comply with these Terms, the platform’s editorial policy or its commercial positioning. Conceptfabriek is not required to publish every submission and may refuse a vacancy without providing detailed justification.
Where a paid vacancy is rejected before publication solely because it does not fit the scope of Architectjob.in, Conceptfabriek may, at its discretion, offer a correction, credit, alternative platform or refund. No refund is due where rejection results from misleading information, unlawful content, fraud, intellectual-property infringement, an unauthorised recruiter, repeated non-compliance or another breach attributable to the customer.
Review, acceptance, editing or publication of a vacancy does not constitute legal monitoring, verification, endorsement or approval. The employer retains full responsibility for the accuracy, lawfulness and completeness of the vacancy, even where Conceptfabriek has corrected spelling, formatting, categorisation or presentation.
Text, images, logos, videos, portfolios, project images, drawings, plans, files and other materials submitted by a user must be owned by that user or used with sufficient permission. The user warrants that publication and promotional reuse will not infringe copyright, trademark rights, design rights, portrait rights, privacy rights, confidentiality, contractual restrictions or other third-party rights.
By submitting vacancy material, the user grants Conceptfabriek a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, reproduce, resize, crop, format, translate, adapt, distribute, communicate and display that material for operating, publishing, promoting and advertising the vacancy, Architectjob.in and the international Conceptfabriek job-board network. This licence remains valid for promotional material already created or published before the vacancy is removed.
Conceptfabriek may use vacancy titles, company or practice names, logos and uploaded visual material in website listings, newsletters, social-media posts, paid advertising, partner feeds, search engines, printed material and other promotional channels without additional compensation or prior notice, provided that such use relates to the vacancy, employer, architecture practice, platform or Conceptfabriek network.
Employers and architecture practices may upload a company, practice or trademark logo only where they are authorised to use it. Logos, project photographs, architectural images, renders or brand elements belonging to an unrelated third party may not be used to attract attention, imply an unauthorised association or mislead applicants.
Vacancy content is supplied by the employer or its authorised representative. The employer warrants that it has genuine authority to recruit for the advertised role, that the vacancy relates to a real opportunity and that all material information concerning the employer or architecture practice, work location, employment type and application process is accurate.
Approval or publication of a vacancy does not imply that Conceptfabriek agrees with its content, has verified the employer or architecture practice, guarantees the vacancy or confirms compliance with any professional, architectural, labour, immigration, taxation, data-protection or consumer-protection rule.
Users must independently verify the identity and reliability of employers, architecture practices, recruiters and candidates before sharing sensitive information, attending an interview, completing a design test, making travel arrangements, resigning from existing employment, transferring money or entering into an agreement. Conceptfabriek does not guarantee that a user is who that user claims to be.
Architectjob.in may contain links to external websites, application systems, portfolio platforms or services. Conceptfabriek does not control and is not responsible for their availability, security, privacy practices, content, accessibility, products or conduct. Following an external link is at the user’s own risk.
Vacancies may not contain clauses purporting to exclude the employer’s legal responsibility, terms contradicting these Terms, malicious links, hidden redirects, affiliate links, unauthorised tracking technology or prominent links intended primarily to divert visitors to a competing job platform or database.
Payments, taxes and refunds
Prices, currencies, included services, publication periods and applicable taxes are displayed during the ordering process or specified in an individual quotation. Unless expressly stated otherwise, prices exclude VAT, GST, withholding tax, bank fees, payment-processing charges and other governmental charges.
A business customer must pay all invoiced amounts without set-off, counterclaim or deduction. Where the customer is legally required to withhold an amount from a payment, it must provide Conceptfabriek with the official withholding certificate and, to the extent permitted by law, increase the payment so that Conceptfabriek receives the amount it would have received without that deduction.
Paid services commence when Conceptfabriek begins processing, publishing, distributing or promoting the vacancy or otherwise makes the purchased service available. Payments are non-refundable after performance has begun, except where Conceptfabriek expressly agrees otherwise or a refund is required by mandatory law.
A chargeback, payment reversal or payment dispute may not be used as an alternative to the contractual complaint process. Conceptfabriek may suspend accounts, vacancies and services while a payment dispute is pending and may recover payment-provider fees, collection expenses and reasonable legal costs to the extent permitted by law.
Discounts, promotional credits and complimentary publications have no cash value, are non-transferable and may expire. Conceptfabriek may withdraw a promotion where it is misused, duplicated or obtained through false information or multiple accounts.
Prohibited content and conduct
Users may not upload, publish, transmit, store or share material that is unlawful, fraudulent, misleading, defamatory, threatening, harassing, hateful, obscene, sexually explicit, invasive of privacy, discriminatory, violent, exploitative or harmful; infringes intellectual-property or confidentiality rights; impersonates another person or organisation; contains malware; facilitates an offence; threatens public order or security; or otherwise violates applicable law.
Artificially generated, altered or synthetic text, images, architectural renders, audio or video may not be used to impersonate a person or organisation, falsify an employer’s identity, fabricate an architecture practice, project or workplace, or misrepresent a vacancy. Users must provide any disclosure or labelling required by applicable law and may not remove technical identifiers attached to synthetic material.
Conceptfabriek may immediately block, restrict, preserve or remove content and suspend or terminate an account where it reasonably suspects a violation, a security incident, fraud, impersonation, candidate exploitation or unlawful activity. Conceptfabriek may report relevant information to competent authorities where legally required or reasonably necessary to protect users or its rights.
Under these Terms, Conceptfabriek grants users a limited, personal, revocable, non-exclusive, non-sublicensable and non-transferable right to access and use Architectjob.in solely for its intended job-search or recruitment purpose. No ownership or intellectual-property right is transferred to the user.
Users are responsible for maintaining the confidentiality of their login credentials, authentication methods and account access. All activity performed through an account will be attributed to that account unless the user promptly reports unauthorised access and demonstrates that reasonable security precautions were taken.
Conceptfabriek may require password changes, multi-factor authentication, identity verification or other security measures and may invalidate sessions or credentials where necessary to protect the platform or its users.
Job-seeker accounts may not be used to publish vacancies, contact other candidates, collect candidate information or operate recruitment services. Employer access may not be shared with another legal entity, architecture practice, recruitment agency, client, affiliate or third party unless the purchased package expressly permits such use.
Conceptfabriek may suspend, restrict or terminate a user’s access without compensation where the user breaches these Terms, fails to pay, creates security or legal risk, harms the platform’s reputation, abuses another user or interferes with the website’s operation. Provisions intended by their nature to survive termination will remain in force.
Conceptfabriek does not guarantee uninterrupted or error-free access. Maintenance, hosting incidents, cyberattacks, telecommunications failures, software errors, third-party outages, legal orders and events beyond Conceptfabriek’s reasonable control may affect availability. Conceptfabriek is not liable for delays or failures caused by such events.
Intellectual property and database protection
The website, software, design, selection, classification, structure, taxonomy, search results, compilations, vacancy database, candidate database, texts, templates, graphics, logos and other platform elements are owned by or licensed to Conceptfabriek and are protected by contractual rights and applicable copyright, trademark, database and unfair-competition laws.
Conceptfabriek is the producer and operator of the Architectjob.in databases and retains all rights in the collection, verification, arrangement, presentation, updating and commercial exploitation of those databases. Permitted access to individual vacancies or profiles does not grant a right to extract, reproduce or reuse all or a substantial part of a database or to make repeated extraction of insubstantial parts.
Users may not reverse engineer, copy, mirror, frame, reproduce, resell, republish, translate, aggregate, commercially exploit, create a derivative database from, or use the website or its content to train, test, fine-tune, enrich or operate an artificial-intelligence or machine-learning system without Conceptfabriek’s prior written permission.
Access through an undocumented API, rotating proxy, headless browser, automated browser, crawler, spider, scraper, bot, data-extraction service or similar technology is prohibited. The absence of a technical block or a robots.txt restriction does not constitute permission.
Complaints, notices and Indian grievance procedure
General complaints concerning the website or services can be submitted through the contact form or the contact details published on Architectjob.in. Complaints must contain sufficient information to identify the account, vacancy, content or transaction concerned and must clearly explain the requested action.
Where Indian intermediary, e-commerce or consumer-protection rules apply, Architectjob.in will acknowledge and address complaints within the mandatory statutory periods. Requests concerning particularly harmful, intimate, impersonating or unlawful content may be handled under shorter legal deadlines. Complainants must provide the exact URL, supporting information and a declaration that the complaint is made in good faith.
Where available under Indian law, a complainant who is dissatisfied with a decision of the Grievance Officer may use the applicable statutory appeal mechanism. Nothing in these Terms requires Conceptfabriek to remove lawful content merely because it is disputed, criticised or commercially inconvenient.
Passwords are stored using technical security measures intended to prevent them from being read in plain text. No system is completely secure, and users must immediately report suspected unauthorised access, phishing or credential theft.
CV, portfolio and candidate-profile database
Registered job seekers may create or upload a CV, portfolio or candidate profile and may indicate that they are open to being contacted by registered employers or architecture practices. Candidates can deactivate or delete their profile through the available account functionality, subject to legal retention obligations.
Conceptfabriek is not responsible for the accuracy, legality or completeness of CVs, portfolios, project images, drawings, profile photographs, qualifications, professional registrations, employment histories, salary expectations, references or other candidate information. Candidates warrant that they are entitled to publish the uploaded material and that it does not contain confidential information or intellectual property belonging to an employer, client or third party without permission.
By publishing a profile, CV or portfolio, the candidate grants Conceptfabriek the licence necessary to host, format, index internally, display and transmit the profile in accordance with the selected privacy and visibility settings. The candidate retains ownership of the candidate’s original CV, portfolio and profile content.
The visibility of candidate profiles depends on the settings and services available at the relevant time. Unregistered visitors may receive limited or anonymised information, registered employers may receive a summary, and access to identifying or contact information may be restricted to authorised or paying employers.
Search engines and other third parties may sometimes cache, index, archive or reproduce information despite technical instructions requesting that they do not do so. Conceptfabriek will take reasonable measures consistent with the selected visibility setting but cannot guarantee immediate removal from every external cache, archive, browser, recipient system or search result.
A candidate who publishes personal data acknowledges the inherent risks of online disclosure. This does not waive any non-excludable right under applicable data-protection law. Candidates should not upload identity documents, bank information, passwords, medical information or other unnecessary sensitive information to a public or employer-visible profile. Candidates should also avoid uploading confidential client material, unpublished project information, restricted drawings or other material they are not authorised to disclose.
Employers gaining access to candidate profiles, CVs or portfolios may use that access only during the authorised subscription period and only for genuine recruitment. Downloading profiles for resale, permanent database construction, marketing, profiling unrelated to recruitment or disclosure to unauthorised clients is prohibited.
Indemnification
To the fullest extent permitted by law, each employer, architecture practice, recruiter and business user will indemnify and hold harmless Conceptfabriek, its managers, contractors and service providers from third-party claims, regulatory measures, losses, damages, fines, taxes, costs and reasonable legal fees resulting from that user’s vacancy, recruitment activity, candidate processing, uploaded content, infringement, misrepresentation, unlawful conduct, breach of these Terms or violation of applicable law.
Conceptfabriek may assume control of the defence or settlement of a claim covered by the indemnity. The indemnifying user must provide all reasonably requested information and cooperation and may not settle a claim in a manner that imposes an admission, obligation or restriction on Conceptfabriek without its prior written approval.
Limitation of liability
To the fullest extent permitted by mandatory law, Conceptfabriek will not be liable for indirect, incidental, special, punitive or consequential loss; loss of profit, revenue, opportunity, goodwill, anticipated savings or data; recruitment costs; business interruption; or a decision made in reliance on a vacancy, candidate profile, CV, portfolio, employer, architecture practice, external website or communication.
Conceptfabriek is not liable for the acts or omissions of candidates, employers, architecture practices, recruiters, payment providers, hosting providers, social-media platforms, search engines, advertising networks or other third parties, nor for fraud committed by a user unless the liability cannot legally be excluded.
Where Conceptfabriek is nevertheless held liable in connection with a paid service, its total aggregate liability will be limited to the amount, excluding taxes and third-party advertising costs, actually paid to Conceptfabriek for the specific service giving rise to the claim during the twelve months preceding the event. For a free service, total liability will be limited to EUR 100, to the extent such limitation is legally permitted.
Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or another liability that cannot validly be excluded or limited under applicable mandatory law.
A user must notify Conceptfabriek of a claim without unreasonable delay after becoming aware of the relevant circumstances and must take reasonable measures to limit further loss.
Unauthorised copying, republication and crawling
Only search engines, distribution partners, aggregators, advertising platforms and technical service providers expressly authorised by Conceptfabriek may crawl, index, receive or republish Architectjob.in vacancies or candidate information. Technical access or the presence of structured data does not constitute authorisation.
Unauthorised copying, scraping, crawling, syndication, republication or commercial use of a vacancy constitutes a material breach of these Terms and may also infringe Conceptfabriek’s copyright, database rights and other legal rights.
For each vacancy copied or republished without authorisation, the infringing business user agrees that Conceptfabriek may claim liquidated damages of EUR 250 per vacancy for every commenced day during which the vacancy remains available on each unauthorised platform. This amount represents an agreed reasonable advance estimate of investigation, loss of exclusivity, commercial substitution, monitoring and enforcement costs and is subject to any mandatory judicial power to reduce or moderate it.
The liquidated amount does not prevent Conceptfabriek from seeking an injunction, removal order, preservation order, disclosure order, legal costs or compensation for a higher proven loss, but Conceptfabriek will not obtain double recovery for the same damage.
Server logs, access logs, IP addresses, user-agent strings, timestamps, request patterns, screenshots, archived pages, hashes, account records, correspondence, payment records and other electronic records may be used as evidence, subject to applicable evidentiary law.
Conceptfabriek may block IP addresses, networks, accounts, domains, devices, automated agents or service providers associated with unauthorised access and may send takedown notices to hosting providers, registrars, search engines, advertisers, payment providers and other intermediaries.
Severability and interpretation
If any provision of these Terms is held invalid, illegal or unenforceable, that provision will be interpreted or reduced to the minimum extent necessary to make it valid and enforceable. If that is impossible, it will be severed without affecting the remaining provisions.
Headings are included for convenience and do not limit the interpretation of these Terms. Words in the singular include the plural and references to “including” mean “including without limitation”.
Failure or delay by Conceptfabriek to exercise a right or remedy does not constitute a waiver. A waiver is valid only where expressly made in writing by an authorised representative of Conceptfabriek and applies only to the specific circumstances for which it was given.
Conceptfabriek may assign or transfer its rights, receivables, agreements, platform or business activities to an affiliate, purchaser, successor or service operator. A user may not assign or transfer an account, agreement or right without Conceptfabriek’s prior written consent.
These Terms, the order confirmation, the applicable package description and any separately signed agreement constitute the entire agreement concerning the relevant service. In the event of conflict, a separately signed agreement prevails, followed by the order confirmation, package description and these Terms.
Conceptfabriek may amend these Terms where necessary because of legal developments, platform changes, security requirements, new services or commercial changes. The updated version will be published on the website. Material changes affecting an ongoing paid service will be communicated where reasonably required.
Electronic orders, acceptances, communications, invoices, account records and backups may be retained and used as evidence. The parties agree that an electronic acceptance, checkbox, order confirmation, email or authenticated account action may constitute a valid electronic agreement or signature to the extent permitted by law.
The English-language version of these Terms is the authoritative version. A translation is provided only for convenience unless Conceptfabriek expressly states otherwise. In the event of inconsistency, the English version prevails to the extent permitted by mandatory law.
Governing law and dispute resolution
These Terms, every agreement with Conceptfabriek and all contractual and non-contractual obligations arising from or connected with Architectjob.in are governed exclusively by Belgian law, without regard to conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.
For employers, architecture practices, recruiters, recruitment agencies, advertisers, subscribers, corporate users and all other persons using Architectjob.in for a professional or commercial purpose, every dispute arising out of or in connection with these Terms or the services shall be finally settled under the Rules of Arbitration of CEPANI by one arbitrator appointed in accordance with those Rules. The seat and legal place of arbitration shall be Ghent, Belgium. The proceedings shall be conducted in English and the merits shall be decided under Belgian law.
The courts having jurisdiction in Ghent, Belgium shall have exclusive jurisdiction over applications relating to the constitution of the arbitral tribunal, interim or protective measures, challenges, setting aside proceedings and every matter that must be submitted to a national court at the seat of arbitration.
To the maximum extent permitted by law, any claim brought by a job seeker or other non-business user against Architectjob.in, Conceptfabriek or its representatives must be brought exclusively before the competent courts of Ghent, Belgium. The user irrevocably submits to those courts and waives objections based on distance, inconvenience, domicile or forum non conveniens.
Nothing in these Terms deprives a user of a right or remedy that cannot legally be waived under mandatory applicable law. Where a mandatory authority or court has non-excludable jurisdiction, the remaining provisions concerning Belgian law and the limitation of Conceptfabriek’s liability will continue to apply to the fullest lawful extent.
Notwithstanding the foregoing, Conceptfabriek may seek interim, injunctive, conservatory, debt-recovery, intellectual-property, anti-scraping or enforcement relief in any jurisdiction where a user, infringer, asset, server, domain, platform or relevant evidence is located. Exercising that right does not constitute acceptance by Conceptfabriek of that jurisdiction for claims brought against it.
A foreign judgment or arbitral award may be recognised or enforced in any jurisdiction in accordance with the procedural and mandatory laws applicable there.
Before starting formal proceedings, the claimant must send a sufficiently detailed written notice of dispute and allow at least thirty calendar days for an attempted amicable resolution, except where urgent interim or protective relief is reasonably required.
